1. Introduction

Welcome to ARTERA Beauty, sub-brand of ARTERA SRL (“we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your use of our website, products, and services, including the purchase and use of digital Canva templates, illustrations and other digital products. By accessing or using our website and purchasing our products, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using our services.

2. Definitions

• “Company”, “We”, “Us”, and “Our”** refer to ARTERA Beauty.
• “Product” refers to the digital Canva templates, illustrations and any related services or products provided by us.
• “License” refers to the permission granted to you to use the Product under the specified conditions.

3. License of Use

When you purchase a product from ARTERA Beauty, you are granted a limited, non-exclusive, and non-transferable license to use the product in accordance with the following terms:

• Personal Use: You are free to use the purchased templates and illustrations for personal, non-commercial projects. This includes creating designs for your own social media, personal branding, or individual projects.
• Commercial Use: You may use the templates and illustrations to create content for your business, clients, or other commercial purposes. However, you may not resell, sublicense, or distribute the original templates or illustrations in their original or editable format. You are allowed to create end products such as social media posts, banners, flyers, and other promotional materials using the templates, but illustrations cannot be modified in any way.
• Templates Modification Rights: You have full rights to edit, alter, and modify the templates to suit your needs. This includes changing colors, fonts, images, and layout. However, the original template design remains the intellectual property of ARTERA Beauty, and you cannot claim ownership or authorship of the original template itself.
• Illustrations: All illustrations provided are non-modifiable. You are not permitted to alter, change, or modify any aspect of the illustrations, including colours, size, or any other design elements. They must be used in their original format as provided.
• Prohibited Actions: You are not allowed to:
• Share or distribute the template or illustrations in their original or editable format (e.g., Canva link) to others, whether for free or paid.
• Use the template or illustrations as a base for creating your own competing products.
• Claim the templates or illustrations, or any of their components, as your original design, even after making modifications to the templates.

4. Products

We sell digital products, including Canva templates and illustrations, which are intended for personal or commercial use. These products are provided in an editable format within the Canva platform, but not limited to this. It is the user’s responsibility to ensure they have access to Canva to use the products. Each product’s specific usage rights and restrictions are detailed in the License of Use section above.

• Canva Templates: These are editable design files that you can customise to suit your needs. You have the rights to modify templates as specified in the License of Use section. This includes changing colours, fonts, images, and layouts to create personalised designs for your projects or business needs.

• Illustrations: These are graphic elements provided as part of our products. Illustrations are provided in a non-modifiable format and cannot be altered, changed, or modified in any way. They must be used in their original form as provided. You may incorporate illustrations into your designs but must not attempt to edit or customise them beyond their original state.

5. Purchasing and Payment

All sales of digital products are final. Once payment is completed, you will receive a download link or access to the purchased product. By purchasing a product, you acknowledge that:

• No Refunds or Exchanges: Due to the digital nature of our products, we do not offer refunds or exchanges once a purchase is completed and the product is accessed or downloaded.

• Payment Processing: Payments are processed securely through Shopify Payments or Stripe and other available methods. We accept Visa, MasterCard, PayPal. All transactions are subject to the terms and conditions of the respective payment providers.

• Order Confirmation: After completing your purchase, you will receive an order confirmation via email. Please ensure that your contact information is accurate to receive your purchase details. 

6. Refund Policy

Due to the digital nature of our products, all sales are final, and no refunds or exchanges will be provided once a template has been purchased and accessed. 

• Non-refundable Purchases: Since templates are digital and delivered instantly, we are unable to offer refunds. Please ensure that you carefully review the product description, including sample images or previews, before making your purchase.
• Issue Resolution: If you experience any issues with downloading, accessing, or editing a template, or if the product is defective in any way, please contact our customer support at contact@arteragraphics.com or use the Contact form. We will make reasonable efforts to assist you, such as providing a replacement download link or troubleshooting tips.
• Chargebacks and Disputes: Any attempts to dispute or charge back a legitimate purchase may result in the suspension of your account and access to all previously purchased products. Please reach out to our support team before initiating any disputes so we can help resolve any issues.

By purchasing, you agree to these terms and accept the nature of digital product delivery. 

7. Copyright 

All products and services are the intellectual property of ARTERA Beauty. By purchasing, you do not acquire any ownership rights to the templates. You are granted a license to use the templates under the terms specified in Section 3 (License of Use). Unauthorised use, reproduction, or distribution of our templates is strictly prohibited and may result in legal action and payment of compensation.

8. Disclaimer

All templates and digital products provided by ARTERA Beauty are offered on an “as is” basis without any warranties or guarantees. Also, please note that the images are only for presentation purposes and they may suffer changes. We make no representations regarding the suitability, reliability, or availability of our products for any specific use.

• No Guarantee of Outcomes: While we strive to create high-quality templates, we cannot guarantee that using our templates will achieve any specific results, such as increased engagement, sales, or visibility for your business or personal use. 
• Platform Limitations: The templates are designed to be used with Canva. We are not responsible for any issues arising from the Canva platform itself, such as compatibility, availability, or changes in Canva’s functionality that may affect your use of the templates. 
• No Warranty: We do not provide any warranties, express or implied, regarding the performance of our templates, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of the templates is at your own risk. 
• Third-Party Content: Some templates may include links to third-party content or images that are subject to their own licenses and terms of use. It is your responsibility to ensure that you have the necessary rights to use any third-party content or images included in your final designs.

By using our products, you agree to assume full responsibility for the consequences of using or modifying the templates.

9. Liability Limitation

To the fullest extent permitted by law, ARTERA Beauty shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from: 

• Your access to or use of or inability to access or use the templates.
• Any unauthorised access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, trojans, or the like that may be transmitted to or through our templates by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the templates.

10. Termination

We reserve the right to terminate or suspend your access to our templates and services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. 

Upon termination, your right to use the templates will immediately cease. If you wish to terminate your account, you may simply discontinue using the templates and services. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. All changes are effective immediately when we post them and apply to all access to and use of the templates thereafter. Your continued use of the templates following the posting of revised Terms means that you accept and agree to the changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our templates shall be resolved exclusively in the courts of Romania.

By using our services, you consent to the exclusive jurisdiction and venue of these courts.

13. Severability 

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, so that these Terms will otherwise remain in full force and effect and enforceable.

14. Entire Agreement

These Terms constitute the entire agreement between you and blancstudiostore.com regarding your use of our templates and supersede all prior agreements, understandings, and representations, whether oral or written, regarding the same.
